A Cocke County Tennessee man who was arrested for watching a cockfight is facing charges in both state and federal court. Michael Webb wanted to contest the charges in state court but those charges were dismissed at the request of prosecutors who wanted to try the case in U.S.District Court in Greeneville. On Friday, a Cocke County judge reinstated the state charges at Webb’s request, but the move doesn’t necessarily cancel the federal charges. The double jeopardy rule doesn’t prevent state and federal prosecution of the same offense. If he’s prosecuted in federal court he faces up to one year in jail and a fine of up to $15,000 if convicted. In state court, he faces a maximum penalty of a $50 fine and 30 days in jail.
