THE JUVENILE WAS ORIGINALLY CHARGED WITH ATTEMPTED CAPITAL MURDER, ARMED ROBBERY, AND USE OF A FIREARM IN THE COMMISSION OF A FELONY FOR THE INCIDENT AT THE VILLAGE TRUCK STOP. ACCORDING TO ASSISTANT COMMONWEALTH ATTORNEY HERB CLAY, UNDER VIRGINIA LAW A JUVENILE UNDER 16 CANNOT BE CHARGED WITH ATTEMPTED CAPITAL MURDER. A PRELIMINARY HEARING IS SET FOR NOVEMBER 14TH. MEANWHILE, 35 YEAR OLD DEREK EVAN FISHER OF RURAL RETREAT IS CHARGED WITH ATTEMPTED CAPITAL MURDER, ARMED ROBBERY, AND FURNISHING A JUVENILE WITH A FIREARM IN CONNECTION WITH THE SAME INCIDENT. A STORE CLERK WAS SHOT IN THE FACE DURING THE ROBBERY. HE IS CONTINUING TO RECOVER FROM HIS INJURIES.
