THE MOTHER OF A UNICOI COUNTY MAN KILLED IN A TRAIN ACCIDENT LAST YEAR HAS FILED A WRONGFUL DEATH LAWSUIT AGAINST CSX RAILROAD. BONNIE FRANCE IS SEEKING FIVE MILLION DOLLARS IN DAMAGES. DANIEL FRANCE JR’S VEHICLE WAS CROSSING THE TRACKS ON BUCKEYE ROAD LAST MAY WHEN HIS VEHICLE WAS STRUCK. THE LAWSUIT ALLEGES THE TRAIN CREW DIDN’T SOUND A HORN AT THE CROSSING EVEN THOUGH THEY SAW FRANCE’S CAR APPROACHING THE TRACKS AND MADE NO EFFORT TO STOP OR SLOW THE LOCOMOTIVE. CSX CLAIMS THE TRAIN BLEW ITS HORN AND RANG ITS BELL REPEATEDLY AS THE VEHICLE APPROACHED THE CROSSING, BUT THE AUTOMOBILE STILL PULLED INTO ITS PATH. NO TRIAL DATE HAS BEEN ANNOUNCED.
