CITING AN ERROR WAS MADE BY A TRI CITIES JUDGE, THE TENNESSEE COURT OF CRIMINAL APPEALS HAS ORDERED A NEW TRIAL FOR A WOMAN CONVICTED OF KILLING HER BOYFRIEND. WENDI NICOLE GARRISON WAS CONVICTED OF SECOND DEGREE MURDER IN THE DEATH OF JOSHUA PERRY IN CARTER COUNTY IN MARCH 2005. THE HIGH COURT RULED JUDGE LYNN BROWN ERRED WHEN HE FAILED TO INSTRUCT THE JURY TO CONSIDER A LESSER CHARGE OF INVOLUNTARY MANSLAUGHTER. A NEW TRIAL DATE HAS NOT YET BEEN SET.
