A RICHMOND JUDGE HAS INVALIDATED A PERMIT FOR A COAL BURNING POWER PLANT UNDER CONSTRUCTION IN SOUTHWEST VIRGINIA. CIRCUIT JUDGE MARGARET SPENCER RULED THAT DOMINION VIRGINIA POWER SHOULD HAVE OBTAINED A MERCURY EMISSIONS PERMIT BEFORE BEGINNING CONSTRUCTION ON THE WISE COUNTY PLANT WHICH IS ABOUT 20 PERCENT COMPLETE. DOMINION OFFICIALS SAY THE COMPANY’S ATTORNEYS ARE STILL REVIEWING THE DECISION AND HAVE NO IMMEDIATE COMMENT.
