A SULLIVAN COUNTY MAN ACCUSED IN THE OLDEST MURDER CASE IN THE COUNTY HAS BEEN PLACED ON HOLD AGAIN. CRIMINAL COURT JUDGE ROB MONTGOMERY HAS SAID HE WILL SENT TO THE CRIMINAL COURT OF APPEALS AT THE REQUEST OF WILLIE PUCKETT’S ATTORNEY IN AN EFFORT TO QUASH A TRIAL. PUCKETT WAS ACCUSED OF KILLING HIS CELLMATE IN 1985 HAS SPENT MUCH OF HIS TIME IN A STATE MENTAL HEALTH INSTITUTION. HIS ATTORNEY CLAIMS THAT BRINGING HIM TO TRIAL VIOLATES HIS CONSTITUTIONAL RIGHTS TO DUE PROCESS AND TO A SPEEDY TRIAL. PUBLIC DEFENDER STEVE WALLACE PLANS TO FILE AN INTERLOCUTORY APPEAL AFTER THE JUDGE DENIED HIS EARLIER MOTION TO DISMISS THE CHARGES.
