TRIAL FOR AN EX-KINGSPORT POLICE OFFICER FACING PUBLIC INTOXICATION CHARGES OUT OF JOHNSON CITY IS SET FOR LATER THIS WEEK. 35 YEAR OLD JASON MCLAIN OF MOUNT CARMEL WILL ANSWER ALLEGATIONS STEMMING FROM A PARKING LOT ENCOUNTER WITH A JOHNSON CITY POLICE OFFICER. MCLAIN WAS A 13-YEAR VETERAN OF THE KINGSPORT POLICE DEPARTMENT WHEN JOHNSON CITY POLICE ARRESTED HIM ON AUGUST 27TH, 2007. HE WAS ARRESTED FOLLOWING AN ALTERCATION AT 3 A.M. WITH AN OFFICER AFTER HE WAS PULLED FROM A VEHICLE IN THE PARKING LOT OF THE ELECTRIC COWBOY ON NORTH ROAN STREET. JOHNSON CITY POLICE SAY MCLAIN WAS EITHER ASLEEP OR INTOXICATED WHEN AN OFFICER TRIED TO WAKE HIM UP. THE TWO SCUFFLED ON THE GROUND, AND MCLAIN WAS ARRESTED. MCLAIN IS ELIGIBLE FOR PRETRIAL DIVERSION WHICH WOULD ALLOW MCLAIN TO AVOID A CONVICTION, SPEND A SPECIFIED TIME ON PROBATION, AND EVENTUALLY GET THE CHARGES EXPUNGED FROM HIS RECORD. MCLAIN IS SCHEDULED TO GO ON TRIAL ON THURSDAY.
