ATTORNEYS FOR A WASHINGTON COUNTY TENNESSEE MAN WHO WAS ORDERED TO SPEND SIX YEARS IN PRISON FOR THE DEATH OF A HOMECOMING QUEEN HAVE FILED A NOTICE THEY WILL APPEAL THE OUTCOME OF THE CASE. 40 YEAR OLD DAVID PHILLIPS WAS CONVICTED ALONG WITH 20 YEAR OLD BRADLEY MULLINS OF DRAG RACING, VEHICULAR HOMICIDE AND AGGRAVATED ASSAULT IN THE DEATH OF 17 YEAR OLD CORTNEY HENSLEY. THE NOTICE FILED RECENTLY, APPEALS JUDGE ROBERT CUPP’S DENIAL OF A NEW TRIAL TO THE COURT OF CRIMINAL APPEALS IN KNOXVILLE. IT ALSO APPEALS THE JUDGE OF CONVICTION AND SENTENCE IN THE CASE. A JURY ACQUITTED BOTH MEN OF SECOND DEGREE MURDER. MULLINS BEGAN SERVING A FIVE YEAR PRISON SENTENCE IN JANUARY WHILE PHILLIPS REMAINS FREE ON BOND PENDING HIS APPEAL. MULLINS’ CAR CRASHED INTO THE BACK OF HENSLEY’S VEHICLE AT AN ESTIMATED SPEED OF 130 MPH. HER BEST FRIEND, COURTNEY BEARD SUFFERED THIRD DEGREE BURNS OVER MOST OF HER BODY BEFORE BEING PULLED FROM THE BURNING SUV.
