A JUDGE HAS DENIED A NEW TRIAL FOR ONE OF THE TWO MEN CONVICTED OF VEHICULAR HOMICIDE IN A SEPTEMBER 2005 DRAG RACE THAT LED TO THE DEATH OF ONE TEEN AND THE SERIOUS INJURY OF ANOTHER TEEN. JUDGE ROBERT CUPP MADE THE DECISION IN WASHINGTON COUNTY TENNESSEE CRIMINAL COURT AT A HEARING FOR DAVID PHILLIPS. CUPP SENTENCED PHILLIPS TO SIX YEARS BEHIND BARS BACK IN DECEMBER FOR INDIRECTLY KILLING CORTNEY HENSLEY AND INJURING COURTNEY BEARD. PHILLIPS HAD FILED A MOTION ASKING FOR A NEW TRIAL SAYING THAT HE DID NOT RECEIVE A FAIR TRIAL. AFTER THREE HOURS OF DISCUSSION, JUDGE CUPP RULED THAT THE JOINT TRIAL FOR PHILLIPS AND BRADLEY MULLINS WAS COMPLETELY FAIR. HOWEVER, ATTORNEYS FOR PHILLIPS SAY THEY WILL CONTINUE THE APPEALS PROCESS. PENDING COMPLETION OF THE APPEAL, PHILLIPS REMAINS FREE ON BOND.
