A SECOND PERSON ACCUSED IN THE MURDER OF A SOUTHWEST VIRGINIA MAN NEARLY 22 YEARS AGO HAS DECIDED TO FIGHT EXTRADITION FROM NORTH CAROLINA. 47 YEAR OLD ROBERT BANKS OF HENDERSONVILLE IS CHARGED ALONG WITH 39 YEAR OLD JOHN FRANKLIN TERRY IN THE NOVEMBER 1986 KILLING OF 85 YEAR OLD ODIE DUFF. DUFF WAS FOUND STRANGLED AND STABBED TO DEATH IN HIS BIG STONE GAP HOME. BOTH BANKS AND TERRY FACE FIRST DEGREE MURDER CHARGES. AUTHORITIES WERE ABLE TO USE DNA EVIDENCE TO LINK TERRY TO THE CRIME, BUT IT’S UNCLEAR WHAT PART BANKS PLAYED IN DUFF’S DEATH. WISE COUNTY COMMONWEALTH’S ATTORNEY RON ELKINS SAID HIS OFFICE HAS APPLIED FOR A GOVERNOR’S WARRANT WHICH WILL FORCE BANKS TO BE BROUGHT BACK TO VIRGINIA. MEANWHILE, TERRY REMAINS HELD WITHOUT BOND IN THE SOUTHWEST VIRGINIA REGIONAL JAIL IN DUFFIELD.
