EVEN THOUGH IT TOOK AUTHORITIES NEARLY THREE YEARS TO GET A KINGSPORT MAN BACK IN CUSTODY, HE’S STILL ELIGIBLE FOR BOND. 64 YEAR OLD DONALD LYNCH IS CHARGED WITH 11 COUNTS OF RAPE OF A CHILD, 38 COUNTS OF AGGRAVATED SEXUAL EXPLOITATION OF A MINOR AND FIVE COUNTS OF AGGRAVATED SEXUAL BATTERY. LYNCH POSTED BOND IN JUNE OF 2004 AND WASN’T HEARD FROM UNTIL HIS CAPTURE IN OCTOBER IN MEXICO. TENNESSEE LAW PROHIBITS AN INMATE FROM BEING HELD WITHOUT BOND UNLESS THEY’RE CHARGED WITH A CAPITAL OFFENSE. IF LYNCH’S ATTORNEY DOES REQUEST A NEW BOND, IT COULD BE SET IN THE MILLIONS MAKING IT HIGHLY UNLIKELY FOR HIM TO BE ABLE TO POST IT. MEANWHILE, A FEDERAL CHARGE AGAINST LYNCH OF UNLAWFUL FLIGHT TO AVOID PROSECUTION HAS BEEN DROPPED. ACCORDING TO SULLIVAN COUNTY DISTRICT ATTORNEY GENERAL GREELEY WELLS, THIS ISN’T UNUSUAL BECAUSE THE CHARGE IS USED TO HELP AID LOCAL LAW ENFORCEMENT AGENCIES IN FINDING CRIMINALS.
